Terms of Service

1. Scope

1.1 These Terms of Service (hereinafter "Terms") apply to all contracts concluded via the online shop AIS-Tours Bento (hereinafter "Webshop") between the operator of the Webshop, AIS Tours Bento (hereinafter "Provider"), and the customer (hereinafter "Customer").

1.2 Deviating, conflicting or supplementary general terms and conditions of the Customer shall not become part of the contract, even if known, unless their validity is expressly agreed to in writing.  

2. Conclusion of Contract  

2.1 The presentation of the tours in the Webshop does not constitute a legally binding offer, but a non-binding invitation to order.

2.2 The Customer submits a binding offer by completing the online ordering process. The contract is concluded when the Provider accepts the Customer's order by an order confirmation via e-mail.

3. Services

3.1 The Provider offers various tours in Switzerland through the Webshop. The detailed description of each tour, including services, prices and any additional costs, can be found in the Webshop.

3.2 The Provider reserves the right to change the offered tours or to remove them from the program if this is necessary for important reasons (e.g. force majeure, safety concerns).

4. Prices and Payment

4.1 The prices stated in the Webshop are in Swiss Francs (CHF) and include the statutory value-added tax.

4.2 The Customer can make the payment by credit card, PayPal or bank transfer.

4.3 Upon booking, the Customer can choose to pay a 30% deposit or the full amount. If a deposit is paid, the remaining amount must be paid one month before the start of the tour.

5. Cancellation

5.1 The deposit (respective 30% of the full amount) is non-refundable.

5.2 If the Customer cancels after paying the full amount, the following cancellation fees apply:

Up to 4 weeks before the start of the tour: 70% of the total amount will be refunded.
Up to 3 weeks before the start of the tour: 50% of the total amount will be refunded.
Up to 2 weeks before the start of the tour: 25% of the total amount will be refunded.
Less than 2 weeks before the start of the tour: 10% of the total amount will be refunded.

5.3 The Provider reserves the right to cancel the tour for important reasons (e.g. bad weather, insufficient number of participants). In this case, the Customer will be refunded the tour price paid. Further claims of the Customer are excluded.

6. Liability

6.1 The Provider is liable for damages caused by intent or gross negligence.

6.2 Liability for slight negligence is excluded.

6.3 The Provider is not liable for damages caused by force majeure, natural events or other unforeseeable events.

6.4 The Provider is not liable for accidents, injuries or illnesses that may occur during the tour. The Customer is responsible for adequate insurance.

7. Data protection

7.1 The Provider processes personal data of the Customer in the context of the contract execution and in accordance with the provisions of the Swiss Data Protection Act.

8. Final provisions

8.1 Swiss law shall apply to this contract.

8.2 Place of jurisdiction is Zürich.

8.3 Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
